Making a complaint

There are a number of mechanisms for employers and employees to resolve disputes. It’s important to note that you can’t have a complaint heard at the same time under both Commonwealth legislation and equivalent state or territory laws. All the Acts have advantages and disadvantages, and the best one for you to use depends on your case.

Some of the things to think about are:

  • Whether your complaint is covered by the Commonwealth Act or a state or territory act
  • What outcomes you want
  • How much it might cost you to make the complaint
  • Whether there are exemptions that apply under one act but not another.
